Authorized use of the Weapon as the Circumstance in the Czech Penal Law.

Abstract:

Tato práce na téma Oprávněné užití zbraně jako okolnost vylučující protiprávnost se zabývá oprávněným užitím zbraně ozbrojenými slož-kami státu. Práce poskytuje popis a vysvětlení základních pojmů, jako zbraň protiprávnost a okolnost vylučující protiprávnost. Dále jsou v práci uvedeny instituty krajní nouze a nutné obrany, jakožto dva pilí-ře užití zbraně a okolností vylučujících protiprávnost. Jsou zde ovšem i zmíněny ostatní okolnosti vylučující protiprávnost, včetně okolností v Hlavě III. Trestního zákoníku neuvedených. Následně je pozornost věnována popisu, jak a za jakých podmínek jsou oprávněny ozbrojené složky státu vč. obecní policie užít zbraň, jaká jsou omezení v užití zbraní a jaké jsou povinnosti po užití zbraně. Je zde zmíněna i proble-matika jednotného velení. Dále se zde nachází stručně uvedena pro-blematika soukromých bezpečnostních služeb. Práce dále obsahuje i komparaci užití zbraně mezi jednotlivými složkami státu a následně porovnání oprávnění užít zbraň mezi policisty v České republice a poli-cisty ve Slovenské republice. V práci je zpracována statistika použití zbraně příslušníky PČR v letech 2015 až 2020. V samém závěru práce je uvedeno několik subjektivních pocitů a názorů na právní úpravu užití zbraně v ČR a několik připomínek de lege ferenda.

Abstract:

This work on the topic of legitimate use of weapons as a circumstance precluding illegality deals with the legitimate use of weapons by the armed forces of the state. The thesis provides a description and ex-planation of basic concepts, such as weapon illegality and the cir-cumstance precluding illegality. Furthermore, the work presents the institutes of extreme emergency and necessary defense as two pillars of the use of weapons and circumstances precluding illegality. Howe-ver, other circumstances precluding illegality are also mentioned here, including the circumstances in Title III. Of the Criminal Code not listed. Subsequently, attention is paid to the description of how and under what conditions the armed forces of the state, incl. municipal police to use the weapon, what are the restrictions on the use of weapons and what are the obligations after the use of weapons. The issue of unified command is also mentioned here. Furthermore, there is a brief issue of private security services. The work also contains a comparison of the use of weapons between the various components of the state and then a comparison of the right to use weapons between police officers in the Czech Republic and police officers in the Slovak Republic. The work deals with the statistics of the use of weapons by members of the Police in the years 2015 to 2020. At the very end of the work are sev-eral subjective feelings and opinions on the legal use of weapons in the Czech Republic and several comments de lege ferenda.
