Abstract:

Cílem mé bakalářské práce bylo popsat problematiku nájmu bytů v českém právu, která je upravena v zákoně Občanské zákoníku. Samotnou práci jsem rozdělila do jedenácti kapitol, které se dále dělí na subkapitoly. V první kapitole jsem vysvětlila pojem byt jako takový a rozdíl dané definice oproti minulým rokům. Ve druhé kapitole jsem se věnovala typům vlastnictví bytů. Ve třetí kapitole jsem vysvětlila pojem a náležitosti nájemné smlouvy. Čtvrtá kapitola obsahuje popsaná práva a povinnosti pronajímatele a nájemců. V páté kapitole jsem popisovala nájemné a další platby, které jsou spojené s nájmem bytu. V šesté kapitole jsem popisovala skončení nájmů a všechny způsoby, kterými k tomu může dojit. Sedmá kapitola obsahuje některé otázky tykajíce se nájmu bytu a vypovědí. V osmé kapitole jsem zmínila Airbnb jako způsob pronájmu. Devátá kapitola popisuje aktuální stav na trhu nemovitosti. Desátá kapitola vysvětluje rozdíl mezi smlouvou o ubytování a nájemné smlouvy. V poslední jedenácté kapitole jsem popsala a rozebrala dotazník s názvem ¨Nájem bytu z pohledu nájemce¨, který jsem vytvořila speciálně pro svoji bakalářskou práci.

Abstract:

The aim of my Bachelor thesis was to closely describe the problematic of renting an apartments and to be understandable and comprehensive for everyone, pursuant to Act No.89/2012 of the Civil Code. The thesis is divided into 11 chapters, which are being divided into smaller parts. In the first chapter I've explained the concept and the meaning of “an apartment” and the difference of definition compared to the past years. In the second chapter I've pursued the types of the apartment ownership. In the third chapter I've explained the concept and the essentials of the lease. Fourth chapter holds the description of rights and obligations of lessor and the tenants. In the fifth chapter I've described the rent and other payments associated with renting an apartment. In the sixth chapter I've described the end of the rent and all the ways in which it can happen or be done. The seventh chapter contains some questions about the lease of the apartment and terminations. In the eighth chapter I mentioned Airbnb as a way of renting. Ninth chapter describes the actual state on the real estate market. The tenth chapter explains the difference between the accommodation contract and the rent contract. In the last eleventh chapter I've described and analyzed a questionnaire called “Renting an apartment from the perspective of a tenant”, which I created especially for my Bachelor Thesis.
