The Invalidity and the Invalidity Pension in the Pension Insurance

Abstract:

Ve své diplomové práci na téma Invalidita a invalidní důchod v důchodovém pojištění jsem se zabývala popisem důchodového pojištění,který je založen na různých principech a především invalidním důchodem. Invalidní důchod doznal s datem 1.1.2010 řadu změn. Nejzásadnější změnou byla transformace částečného invalidního důchodu do invalidního důchodu I. či II. stupně a plného invalidního důchodu do invalidního důchodu III. stupně. Na praktických příkladech jsem prezentovala, jak se změní výše dávek jednotlivých druhů invalidních důchodů z pohledu předchozí právní úpravy vůči současné platné právní úpravě. Také jsem se zabývala popisem důchodové formule, která je složena ze základní a procentní výměry. V další kapitole jsem popisovala důchodové schéma, jimž se rozumí souhrn kumulativně naplněných podmínek k získání nároku na invalidní důchod. Do závěru této diplomové práce jsem zařadila nejdůležitější z právních pramenů mezinárodního práva týkající se oblasti invalidního důchodu.

Abstract:

This thesis is about the Invalidity and the invalidity pension in the pension insurance. At the first I described the pension insurance which is based on a few principles and the invalidity pension too. The invalidity pension has very changed from the date the first of Januar 2010. The biggest change was a transformation the partial invalidity pension to the invalidity pension of the first or of the second degree and the full invalidity pension to invalidity pension of the third degree. On the practical examples I presented how to change the amount of benefits from the each kind of the invalidity pension in the previous legal regulations against the amount of benefits from the each kind of the invalidity pension in the valid legal form. Then I deal with the invalidity formula which is composed of the basic and percentual measurement. In the another chapter I wrote about the invalidity scheme which is understood as the summary of conditions which have to be fulfiled cumulatively to acquire the right to the disability pension. At the end of this thesis I included the most important authorities of the international law in the sphere of the invalidity pension.
