Decision of Offenses Defects

Abstract:

Práce se zabývá vymezením nejčastějších vad v rozhodnutí o přestupcích a zhodnocením vlivu nové právní úpravy na tyto vady. Práce v úvodu charakterizuje základní instituty správího trestání, znaky správních deliktů a náležitosti rozhodnutí o přestucích. V druhé části jsou definovány jednotlivé vady rozhodnutí, vycházející především z judikatury nejvyšších soudů. Přínosem této práce je přinést souhrn nejčastějších vad v rozhodnutí o přestupcích k jejich předcházení v kontextu s novou právní úpravou. Závěr práce je věnován příčinnám vad při uvedení teorie do rozhodovací praxe správních orgánů.

Abstract:

The thesis deals with defining the most frequent defects in the offenses decision and evaluating the impact of the new legal regulation of these defects. The work in the introduction introduces the basic institutes of administrative sanction, the signs of offenses, and the necessity of offenses decision. The second part defines the individual defects of the decision, based mainly on the jurisprudence of the supreme courts of the Czech republic. The benefit of this work is to bring together the most common defects in the offenses decision, and how to prevent them in the context of new legislation. The conclusion of this thesis is devoted the causes of defects, with putting the theory into the administrative authorities decision-making.
