Autonomy of Testators Will

Abstract:

Diplomová práce se zabývá problematikou autonomie vůle v dědickém právu. Tato problematika není v české ani zahraniční literatuře běžně zpracovávána. Práce se skládá ze sedmi kapitol, stěžejním tématem je promítnutí autonomie vůle zůstavitele ve vybraných dědických titulech, její omezení a nastínění možného řešení vůle zůstavitele za života. Pozornost je zaměřena také na další zásady dědického práva související se zásadou autonomie vůle. Přiblížena je i autonomie vůle osob na dědickém řízení zúčastněných. Cílem práce je provedení rozboru autonomie vůle zůstavitele, zejména rekodifikované právní úpravy, včetně částečného srovnání s dosavadní právní úpravou, doplněné o možné řešení úpravy do budoucna v kontextu změn společenských.

Abstract:

This Diploma thesis deals with the issue of Autonomy of the will in Law of Succession. This issue is not commonly solved in Law of Succession in Czech neither foreign literature. The the thesis consists of seven chapters, the main focus of this thesis is a reflection of Autonomy of the will in selected heritage titles, its restriction and suggestion of potentional solution of testator´s will during the life. Attention is also focused on the other principles of the Law of Succession which are connected with the Autonomy of the will principles. The thesis also deals with the Autonomy of the will of persons involved in the inheritance proceedings. The aim of the thesis is to make an analysis of Autonomy of the will of testator especially in regard to recodified legislation, including partial comparison with existing legislation, accompanied by potentional solutions of legislation in the future in the context of changes of society.
