Abstract:

Dizertační práce nazvaná Právo na ochranu zdraví a cizinci si klade za cíl zmapovat v kontextu České republiky právní rámec a relevantní judikaturu ve vztahu k přístupu cizinců ke zdravotní péči. Vedle toho se pokouší identifikovat základní problémy, kterým cizinci v této souvislosti čelí. Navazuje přitom na rigorózní práci s názvem Právo na zdraví: mezinárodní kontext a judikatura Ústavního soudu ČR, v níž byly podrobně popsána obecná východiska dané problematiky. Tato dizertace se pak zaměřuje výhradně na „cizinecký aspekt“ práva na zdraví, čemuž je uzpůsobena též její struktura redukující obecný úvod na nezbytné minimum. Je neskromnou ambicí tohoto textu pojmout problém přístupu cizinců ke zdravotní péči – coby součást práva na (ochranu) zdraví – vyčerpávajícím způsobem na mezinárodní, unijní i vnitrostátní úrovni.

Abstract:

The dissertation entitled Right to Protection of Health and Non-citizens aims to describe the legal framework and relevant case-law concerning the access of foreigners to health care in the context of the Czech Republic. In addition, it attempts to identify the basic issues foreigners have to face in this respect. It follows up on the doctoral thesis named Right to Health: The International Context and The Case-Law of The Constitutional Court, in which the general notions of the issue were described in detail. This dissertation focuses exclusively on the “non-citizen aspect” of the right to health, which is reflected into its structure and thus reducing the general introduction to the necessary minimum. It is an immodest ambition of this text to address the issue of foreigners' access to health care - as part of the right to (protection of) health - exhaustively at the international, European Union and national level.
