Authorized use of firearms- fact negative the unlawfulness of the act

Abstract:

Cílem bakalářské práce je provést výklad zákonných ustanovení spojených s oprávněním strážníka, policisty a případně příslušníků dalších ,,bezpečnostních sborů“ k použití zbraně a s povinnostmi před použitím zbraně, při a po jejím použití. V úvodu práce je definován pojem okolnosti vylučující protiprávnost. Těžištěm bakalářské práce je oprávněné použití zbraně, subjekty vztahující se k problematice oprávněného použití zbraně a definice pojmu zbraň dle příslušných ustanovení. Následně se v rámci dané problematiky zaměřujeme konkrétně na policisty a strážníky. V závěru rozebíráme statistiky týkající se použití zbraně policistou a strážníkem.

Abstract:

The goal of this bachelor thesis is to list and interpret the legislation connected with the right of a law enforcement officer to use arms and their responsibilities before, after and when using arms. In the introduction of the thesis the circumstances excluding illegality are defined. The focus of this thesis is the rightful use of arms, subjects connected with the topic of rightful use of arms and defining the term “arm” with regard to the according legislation. These topics will be discussed with relevance to police officers. In the conclusion, the statistics of police officer arms usage will be analyzed.
