Necessary defense, it's limits and transgression of them

Abstract:

Hlavním cílem této práce bylo popsat a izolovat podmínky, zásady, meze nutné obrany a případy jejich porušení. V první části je vymezen pojem a druhy okolností vylučujících protiprávnost, kterým se věnuje první kapitola této práce. Druhá kapitola je věnována stručnému porovnání současné právní úpravy nutné obrany s měnící se historickou úpravou. Dále se pak práce konkrétně zaměřuje na institut nutné obrany v trestněprávní teorii, kde se snaží dostatečně vystihnout a vysvětlit pojmy související s nutnou obranou s hlavním zaměřením na podmínky a meze nutné obrany, ale také na překročení těchto mezí. V kapitole čtvrté jsou tyto teoretické poznatky aplikovány na výběr případů, ve kterých je analyzován stav související s nutnou obranou. V předposlední kapitole se opět vyskytuje stručné porovnání právní úpravy, tentokrát však ve vztahu k zahraničí. Finálně se pak v šesté kapitole objevuje shrnutí všech podmínek, zásad a mezí nutné obrany, které byly zjištěny v rámci studia tématu a v této práci detailněji rozvedeny. Závěr práce je z velké části věnován názorům autora na jednotlivé poznatky, které obdržel při vypracování této práce.

Abstract:

The main purpose of this thesis was to describe and isolate the conditions, principles and limits of necessary defence and cases of violation of those limits. The first part describes the concept and types of circumstances precluding illegality, which is addressed in the first chapter of this thesis. The second chapter is devoted to a brief comparison of the current legislation on necessary defence with the ever changing historical legislation. Furthermore, the work specifically focuses on the istitute of necessary defence in criminal law theory, where it tries to sufficiently describe and explain the concepts related to necessary defence with the main focus on the conditions and limits of necessary defence, but also on violation of these limits. In the fourth chapter, these theoretical findings are applied to the selection of cases in which the situation related to the necessary defence is analyzed. In the penultimate chapter, there is again a brief comparison of the legislation, but this time in relation to abroad legislations. Finally, in the sixth chapter there is summary of all the conditions, principles and limits of necessary defence, which were identified during the study of the topic and in this work elaborated in more detail. The conclusion of the thesis is largely devoted to the views of the author on the individual findings that he received during the creation of this thesis.
