Legal adjustment of the protection of consumer in the Czech law

Abstract:

Cílem této práce je analýza právní úpravy ochrany spotřebitele v českém právu a to především s ohledem na současné znění příslušných právních předpisů, jejich významné změny a implementace práva Evropské unie. Text práce se, kromě úvodu a závěru, člení na pět částí. První část práce se týká významu pojmů spotřebitel a podnikatel, které mají podstatný význam v rámci právních předpisů, které se týkají ochrany spotřebitele, protože z charakteristiky jejich vztahů vyplývá i potřeba zákonné ochrany spotřebitele. V druhé části práce jsou analyzovány spotřebitelské smlouvy jako základní dokument upravující vztahy mezi spotřebitelem a podnikatelem. Třetí část práce se týká zákona o ochraně spotřebitele. Analyzuje implementaci práva EU do zákona o ochraně spotřebitele a obsahuje také úvahy o potřebnosti změn tohoto zákona. Čtvrtá část práce se týká nekalosoutěžního jednání a nekalých obchodních praktik. Zde je analyzován způsob úpravy této problematiky v novém občanském zákoníku a zákoně o ochraně spotřebitele. V páté části práce jsou specifikovány státní orgány, které vykonávají dozor nad ochranou spotřebitele včetně jejich působností. S ohledem na komplexnost a rozsah problematiky, která je předmětem této práce, nebyly analyzovány nebo komentovány veškerá ustanovení dotčených právních předpisů, a proto bylo nutné použít i výběrovou metodu, a to podle zvážení významnosti. Protože součástí zaměření této práce je právní úprava, obsahuje tato práce v podstatném rozsahu citace z odborné literatury a dalších pramenů, které jsou uvedeny v seznamu bibliografických odkazů.

Abstract:

This bachelor’s thesis aims to analyze legal regulation of consumer protection in Czech law, especially with regards to the current version of respective legal acts, their significant changes and implementation of European law. Apart from the introduction and conclusion, the body of the text is divided into five parts. The first part of the thesis is concerned with the meaning of the term consumer and business which are both of real importance in terms of legal regulations because the nature of their relationship implies the need for legal protection of the consumer. The second part of the thesis analyses consumer contracts as key documents regulating the relationship between the consumer and business. The third part of the thesis is concerned with the Consumer Protection Act. It analyses the implementation of European law into the Consumer Protection Act as well as reflects upon the need to update this law. The fourth part of the thesis looks at unfair competition and commercial practices. It studies how this problem is treated within the new Civic Code and the Consumer Protection Act. The fifth part of the thesis specifies the public authorities which oversee consumer protection and the scope of their mandates. Considering the complexity and scope of the topic covered by this thesis it would not be possible to analyze and comment on all provisions of the legal acts concerned. It was therefore necessary to apply a selection method, based on judging the importance. As this theses is, among other, concerned with legal regulation, it contains a range of quotations from academic literature and other sources, all listed in the bibliography.
