Volný pohyb pracovníků v EU je jedním ze základních práv poskytovaných v souvislosti s členstvím v EU. Abychom pochopili, kdo všechno je za pracovníka považován, musíme tento pojem podrobit unijnímu právu. To sice neposkytuje přesnou definici, avšak za pomocí znaků plynoucích z judikatury ESD, můžeme tento pojem přiblížit. Free movement of workers within the EU is one of the fundamental rights provided in connection with membership in the EU. To understand who is considered as such worker, the concept „union law“ is established.
