The Protection of Whistleblowers (Whistleblowing)

Abstract:

Bakalářská práce s názvem Ochrana oznamovatelů korupce (whistleblowing) se zabývá v posledních letech velmi aktuálním tématem v České republice, a to whistleblowingem. Práce je zachycena jak v teoretické, tak i v praktické rovině a klade důraz především na nedostatečnou ochranu osob oznamujících korupci. V práci je popsán současný stav právní úpravy whistleblowingu v tuzemské legislativě, kde je ochrana obsažena pouze okrajově, a současně jsou v ní rozebrány již uplynulé legislativní návrhy, které nebyly úspěšné. Na základě analýzy těchto informací a rozhovorů s respondenty, kteří si v důsledku nedostatečných ochranných prostředků prošli závažnými odvetnými opatřeními, autorka zhodnocuje postavení těchto osob a na závěr doporučuje, na základě zjištěných skutečností, další možné kroky ke zlepšení statu quo whistleblowerů.

Abstract:

The bachelor thesis „Protection of whistleblowers” is focused on whistleblowing, which is a very current topic in the Czech Republic. The thesis is examined in both theoretical and empirical parts and emphasizes mainly the insufficient protection of whistleblowers. In further stage, it describes the whistleblowing current legislation in the domestic law, where the protection of whistleblowers is contained only marginally. It also analyses the already expired bills, which were not successful. Based on the analysis of the inquiry and interviews with respondents, who went through serious retaliation due to insufficient protection resources, the authoress evaluates the status of these persons and finally recommends, based on ascertained facts, the next possible steps to the improvement of whistleblower’s status quo.
