Criminal Responsibility of Medical Professionals

Abstract:

Tato diplomová práce řeší trestněprávní odpovědnost zdravotnických pracovníků z pohledu stupně jejich kvalifikace a funkce ve zdravotnických zařízeních. Cílem je zjistit, zda je po právní stránce dostatečně zajištěna bezpečnost pacientů i zdravotníků samotných a zda jsou tresty udělované v různých trestněprávních zdravotnických kauzách adekvátní závažnosti trestných činů. K dosažení těchto cílů jsem použila, krom teoretických faktů, modelové kazuistiky a návazné rozhovory se zdravotníky z odpovídajících oborů. Výsledky této práce ukazují, že právní úprava je v této oblasti na vysoké úrovni, ale také to, že jsou výrazné nedostatky v právním vzdělání zdravotníků a často nejsou dodržovány závazné normy, jejichž cílem je těmto situacím předcházet. V závěru jsou formulována nezbytná opatření, která by zmírňovala dopady nevyhnutelných medicínských komplikací na pacienty a jejich trestněprávní důsledků na zdravotníky.

Abstract:

This diploma thesis deals with criminal liability of health care workers from the point of view of their qualification and function in health care facilities. The aim is to find out whether the safety of patients and health professionals themselves is sufficiently ensured and whether the penalties imposed in various criminal medical cases are adequate for the seriousness of the offenses. To achieve these goals I used, besides theoretical facts, model case reports and follow-up interviews with health professionals from corresponding fields. The results of this work show that the legislation is of a high standard in this area, but also that there are significant shortcomings in the legal education of health professionals and that binding standards aimed at preventing such situations are often not respected. In conclusion, necessary measures are formulated to mitigate the impact of unavoidable medical complications on patients and their criminal consequences on health professionals.
