Abstract:

KÚTNA, Zuzana: Voluntary Auction. [Bachelor thesis]. Banking Institute College of Banking Prague, foreign college Banská Bystrica. Department of Law and Social Sciences. Pages: 59 The Bachelor thesis deals with the examination of the process of the Volunteer auctions in Slovak republic as a tool to satisfy the obligation of the debtor and the creditor. The whole issue of the Volunteer auctions is regulated by Law No. 527/2002 statute, take account The Civic Code 40/1964 statute in the current version. Electronic version of the statutes, for eg. Aspi and Jaspi have been the main source of information for me. Jurisdiction and the court decisions related to the process of the Volunteer auctions and the complaints have been another source for the thesis. I have applied various search methods for eg. analysis method – analysing the statutory text and the court decisions and the comparative method – comparing the legal regulations, from the First Slovak republic times and the present regulations. The next source of the thesis were the practical demonstrations of the Volunteer auction process and that is the making the motion, progress of the auction and finally the registration of the new right of property. In the thesis I have tried to outline the present state of the legislation in the area of the Volunteer auctions, to find out the advantages and the disadvantages of the present legal regulations and at least partially outline their deficiency and the way to solve them. I hope that the thesis will present at least the base information regarding the present state of the legislation in this area.

KÚTNA, Zuzana: Dobrovoľné dražby (Bakalárska práca). Bankovní institut vysoká škola Praha, zahraničná vysoká škola Banská Bystrica, Katedra práva a spoločenských vied. Vedúci práce: JUDr. Kristína Štefániková. Rok obhajoby: 2012. Počet strán: 59 Bakalárska práca sa zaoberá skúmaním výkonu Dobrovoľných dražieb v Slovenskej republike ako prostriedku uspokojenia záväzku, obvykle dlžníka a veriteľa. Problematika a postup výkonu Dobrovoľných dražieb je upravený v Zákone číslo 527/2002 Z.z.. Samozrejme opierajúc sa pritom o Občiansky zákonník 40/1964 Sb.z. v aktuálnom znení. Zdrojom informácií pre mňa boli Zbierky zákonov, predovšetkým ich elektronické verzie, ako napríklad Aspi a Jaspi. A ďalej Judikatúra a rozhodnutia súdov dotýkajúce sa výkonu Dobrovoľných dražieb a námietok vznesených voči ním. Pri skúmaní sme použili viacero metód a to jednak analytickú metódu – analyzovanie znenia zákona a rozhodnutí súdov a komparatívnu metódu – porovnávania právnych predpisov z tejto oblasti, z prvo-republikového obdobia a súčasných ustanovení. Ďalším zdrojom informácií boli pre nás praktické ukážky výkonu Dobrovoľnej dražby, a to od podania návrhu, cez priebeh dražby, až po zápis nového vlastníckeho práva. Prácou sme sa pokúsili načrtnúť súčasný stav legislatívy v oblasti výkonu Dobrovoľných dražieb, zistiť výhody a nevýhody v súčasnosti platných právnych predpisoch a aspoň približne načrtnúť ich nedostatky a veľmi okrajovo aj riešenia. Verím, že táto práca poskytne čitateľovi aspoň základnú informáciu o stave legislatívy v tejto oblasti.
