Legitimate use of Weapon as a Circumstance Excluding Criminal Responsibility

Abstract:

Cílem mé bakalářské práce na téma oprávněné použití zbraně jako okolnosti vylučující trestní odpovědnost, je analyzovat jednotlivé situace, při kterých zákon umožňuje určitým osobám použít zbraň. V úvodní části jsou obecně vymezeny okolnosti vylučující protiprávnost. Následuje obecný rozbor institutu oprávněného použití zbraně společně s vymezením pojmu zbraň. Poté jsou již rozebrány konkrétní situace opravňující k použití zbraně dle jednotlivých právních předpisů. V závěru jsou uvedeny konkrétní případy použití zbraně za podmínek nutné obrany a krajní nouze.

Abstract:

The aim of my bachelor thesis on the subject of “Legitimate use of a weapon as circumstances excluding criminal responsibility” is to analyze the different situations in which the law allows certain persons to use the weapon. The circumstances excluding illegality are generally defined in the introduction. The following is a general analysis of the institute authorized the use of weapons together with the specification of the weapon. The specific situations that justify the use of weapons by individual legislation are discussed thereafter. The conclusion gives the concrete examples of the use of weapons for self-defense and conditions of destitution.
