Tools for tax optimization of Societas Europaea

Abstract:

Tématem diplomové práce jsou nástroje daňové optimalizace evropské společnosti. V první části diplomové práce se nachází teoretické aspekty tématu, např. charakteristika evropské společnosti, její historický vývoj, možnosti vzniku evropské společnosti a v neposlední řadě specifika daňové optimalizace. Ve druhé části diplomové práce jsou vymezeny evropské společnosti na území EU a ČR. V závěru práce je zhodnocení výhod a nevýhod evropské společnosti vč. porovnání, zda tato právní forma podnikání může významněji optimalizovat daně oproti akciové společnosti národní. Cílem práce je vyhodnotit vhodnější právní formu podnikání z hlediska daňové optimalizace na území České republiky, a to prostřednictvím komparace účetních a daňových podkladů evropské společnosti a akciové společnosti.

Abstract:

The theme of this diploma thesis is the tools of tax optimization of European society. In the first part of the thesis there are the theoretical aspects of the topic, e.g. the characteristics of European society, its historical development, the possibilities of creating a European society and, last but not least, the specifics of tax optimization. The second part of the diploma thesis defines European companies in the territory of the EU and the Czech Republic. At the end of the thesis is an evaluation of advantages and disadvantages of European companies incl. Comparing whether a European company as a legal form of business can significantly more optimize taxes than a national stock company. The aim of the thesis is to evaluate the more appropriate legal form of business in terms of tax optimization in the territory of the Czech Republic, by comparing the accounting and tax documents of the European company and the joint stock company.
