Abstract:
Diplomová práce vymezuje pojem smluvní pokuty a úroku z prodlení, její funkce a účel v mezinárodní kupní smlouvě. Instituty mezi sebou porovnává, avšak nikoliv z hlediska platného práva, ale právě z hlediska jejích funkčního smyslu ve smlouvě. The diploma thesis defines the concept of contractual penalty and de-fault interest, their functions and purpose in an international sales con-tract. It compares the institutes with each other, but not from the point of the applicable law, but from the view of their functional meaning in the contract.
