The most common ways of committing economic crime and their detection

Abstract:

Diplomová práce zkoumá základní pojmy hospodářské, ekonomické a finanční kriminality, průzkumem vývoje trestní legislativy od roku 1950 do roku 2009, z pohledu hospodářských trestných činů, zejména trestného činu podvodu. Podrobně vyjadřuje všechny podmínky naplnění skutkové podstaty trestného činu podvodu. Zabývá se vývojem vlastností pachatelů hospodářských trestných činů a změnami struktur pachatelů v čase. Důležitý výzkum byl proveden v oblasti vyhledávání a vyšetřování hospodářských trestných činů a trestného činu podvodu v historii až do roku 1989, včetně působení politického vlivu na důležité ukazatele vyhledávání a vyšetřování. Výzkum definoval jednotlivé stupně vývoje činnosti policejních i justičních orgánů a podmínky zvyšování jejich odbornosti a technické vyspělosti. Práce podrobně zkoumá stav a vývoj odborné kriminalistické literatury, který porovnává s praxí. Studiem dostupných statistických dat zkoumá vývoj v množství zjištěných trestných činů podvodu v určitém období a stanovuje míru vlivu politických a společenských změn v roce 1989 na trestnou činnost. Poukazuje na nové možnosti využití zákonných oprávnění orgány činných v trestním řízení, jakým je finanční šetření nebo využití kybernetiky.

Abstract:

The diploma thesis examines the basic concepts of economic, economic and financial crime, by surveying the development of criminal legislation from 1950 to 2009, from the perspective of economic crimes, especially the crime of fraud. It expresses in detail all the conditions to fulfil the factual nature of the crime of fraud. It deals with the development of the characteristics of perpetrators of economic crimes and changes in the structures of perpetrators over time. An important research has been carried out in the field of search and investigation of economic crimes and the crime of fraud in history up to 1989, including the impact of political influence on the important indicators of search and investigation. The research defined the individual stages of development of the activities of police and judicial authorities and the conditions for increasing their expertise and technical maturity. The thesis examines in detail the state and the development of professional forensic literature, which it compares with practice. The study of available statistical data examines the development in the number of detected crimes of fraud in a certain period and determines the degree of influence of political and social changes in 1989 on crime. It points to new possibilities of the use of legal power by the law enforcement authorities, such as financial investigations or the use of cybernetics.
