Constitutional Referrals as a Platform for Judicial Dialogue: The Case of Czechia

Abstract:

Práce přináší originální konceptualizaci a empirickou studii mechanismu založeného na konkrétní kontrole ústavnosti, prostřednictvím něhož obecné soudy podávají k ústavnímu soudu návrh na objasnění ústavnosti zákona, který má obecný soud použít v řešeném případě. Nejprve teoreticky charakterizuji tento mechanismus v celoevropském kontextu, vymezuji některé jeho funkce a rámuji ho jako platformu pro justiční dialog. Druhou část pak tvoří empirická studie tohoto mechanismu na případu Česka. Zde odpovídám na otázku, jestli tento mechanismus opravdu slouží jako platforma pro dialog o ústavních otázkách. Za tímto účelem jsem provedl tříúrovňovou empirickou analýzu, zahrnující také obsahovou analýzu všech podání obecných soudů a následných rozhodnutí Ústavního soudu.

Abstract:

The thesis originally conceptualises and empirically explores the procedure known as constitutional referrals, where an ordinary court may query a constitutional court to clarify the constitutionality of a law to be applied in a particular case. The thesis delineates its main features and functions, and frames the constitutional referrals procedure as a platform for judicial dialogue on constitutional issues. Building upon that, the second part presents an empirical study of constitutional referrals in Czechia answering the question of whether this mechanism serves as a platform for rational dialogue on constitutional issues. To do so, a three-level analysis was conducted, including content analysis of all submissions of ordinary courts and following rulings by the Constitutional Court.
