Interruptive Elements in the US Supreme Court Arguments

Abstract:

Diplomová práce studuje prvky narušující soudní rozpravu, specificky tu, se kterou se lze setkat v transkripcích jednání Nejvyššího soudu USA. Práce prezentuje Nejvyšší soud USA jako unikátní prostředí soudního systému ve Spojených státech co se týče právních procedur a neverbální i verbální moci. Následně práce přináší novou metodologii identifikace a klasifikace přerušujících prvků vyvozenou ze dvou existujících metod měření přerušení v každodenní mluvě a skupinové rozpravě, přizpůsobenou specifikům a limitacím transkripcí Nejvyššího soudu. Studie analyzuje vzniklé kategorie vzhledem k jejich vztahu k určitým lingvistickým konceptům (například ke Griceovu kooperačnímu principu a konverzačním maximům) společně s četností jejich výskytu v rozpravě a vyvozuje ze zjištěných dat závěry. Kromě kategorizace a analýz přerušení práce samostatně studuje implikaturu a její vztah k narušení rozpravy v tomto specifickém soudním prostředí. Následně studie potvrzuje existenci výjimek a anomálií ve vybraných transkripcích a diskutuje o četnosti jejich výskytu i o implikacích vzhledem k jejich existenci.

Abstract:

The thesis studies interruptive elements within courtroom discourse, specifically observed in the US Supreme Court argument transcripts. The thesis introduces US Supreme Court as a unique environment of the legal system in the USA in terms of legal procedure and both non-verbal and verbal power dynamics. Subsequently the thesis devises a new methodology of identifying and classifying interruptive elements derived from two existing methods of interruption measurement in everyday speech and group discourse, adjusted to fit the specifics and limitations of Supreme Court transcripts. The study considers the created categories in terms of their relation to certain linguistic concepts (including for example Grice’s cooperative principle and conversational maxims), their reoccurrence within the discourse and it draws conclusions based on the findings. Aside from the interruption categorization and analysis, the thesis conducts a separate study of implicature and its relation to interruption within this specific courtroom environment. Furthermore the study acknowledges the existence of exceptions and anomalous instances within the transcripts and considers both their reoccurrence as well as the connotations of their existence.
