The Significance of Records in the Cadastre of Real Estates to Secure Ownership Protection (an Analysis of Czech and English Legal Regulation)

Abstract:

Cílem této rigorózní práce je především posouzení efektivnosti současné právní úpravy katastru nemovitostí při zajišťování ochrany vlastnického práva k nemovitostem a formulace závěrů de lege ferenda. Předkládaná práce analyzuje právní úpravu této problematiky v českém právním řádu a právní úpravu v právním řádu Anglie a Walesu. Také na základě této analýzy se potom pokouší dojít k závěrům, jak vylepšit český registrační systém. Tato práce se podrobněji zabývá ochranou dobré víry nabyvatele nemovitosti, omezením dispozičního oprávnění vlastníka nemovitosti stavem zápisů v katastru nemovitostí (typicky duplicitními zápisy) a důsledky zpětného účinku vkladu ke dni podání návrhu.

Abstract:

The main aim of this rigorous thesis is to assess the efficiency of the current legal regulation of the cadastre in securing protection of real estate ownership and to draw conclusions for future legislation. The thesis analyses the legal regulation of this issue in the Czech legal code and the legal regulation in the legal code of England & Wales. Also on the basis of this analysis, the thesis tries to draw conclusions as to how to improve the Czech registration system. The thesis deals in detail with the protection of the new realty proprietor´s good faith, with the limitation of a proprietor´s right of disposing by the state of records in the cadastre of real estates (typically duplicity of records) and with consequences of retrogressive impact of the entry to the date of filing a proposal.
