Abstract:

Institut nájmu bytu nalézá oporu v zákoně č. 89/2012 Sb., občanský zákoník, který díky obecným i zvláštním ustanovením zajišťuje dostatečnou ochranu takovému nájemci, který hledá byt či dům s úmyslem bydlení či podnikání a pronajímateli, který takový byt nabízí za účelem přenechání určitých práv nájemci oproti protiplnění. Bakalářská práce má za cíl seznámit čtenáře komplexně s problematikou nájmu bytu či domu v rámci čtyř kapitol. Kapitoly postupně odkrývají základní legislativní ustanovení, které se týkají této problematiky. Poslední kapitola se věnuje rozboru nejčastějších problému spojených s nájmem a pronájmem bytu a popisuje jejich praktické řešení dle využívaných právních postupů. Práce poskytuje čtenáři přehled, obsahující základní informace, které upotřebí každý, než vstoupí do potencionálním nájemního vztahu, ale může sloužit i jako návod, pro někoho, koho by se týkaly problémy řešené v kapitole 5.

Abstract:

The institute of renting an apartment finds support in Act No. 89/2012 Coll., The Civil Code, which, thanks to general and special provisions, provides sufficient protection to a tenant who is looking for an apartment or house with the intention of living or business and a landlord who offers such an apartment for abandonment. certain rights of the lessee against consideration. The bachelor's thesis aims to acquaint the reader comprehensively with the issue of renting an apartment or house in four chapters. The chapters gradually reveal the basic legislative provisions that relate to this issue. The last chapter deals with the analysis of the most common problems associated with renting and leasing an apartment and describes their practical solutions according to the legal procedures used. The thesis provides the reader with an overview containing basic information that everyone will use before entering into a potential rental relationship, but it can also serve as a guide for someone who would be affected by the issues addressed in Chapter 5.
