Circumstances Excluding the Illegality

Abstract:

Bakalářská práce je věnována historickému vývoji okolností vylučujících protiprávnost, vymezení problematiky trestní odpovědnosti, dále jednotlivým okolnostem vylučujícím protiprávnost, kterými jsou krajní nouze, nutná obrana, svolení poškozeného, přípustné riziko a oprávněné použití zbraně. Cílem této práce je rozbor aktuální právní úpravy okolností vylučujících protiprávnost a jejich srovnání s aktuální právní úpravou na Slovensku.

Abstract:

The Bachelor thesis focuses on the historical development of the circumstances of justification, definition of the issue of criminal liability, as well as individual circumstances excluding illegality which are necessity, self-defense, the victim's permission, acceptable risk and authorized use of weapons. The aim of this thesis is to analyze the current legislation, the circumstances of justification and their comparison with the current legislation in the Slovak Republic.
