Normative Administrative Acts of Territorially Deconcentrated State Administration Authorities

Abstract:

Diplomová práce se zabývá normativními správními akty územně dekoncentrovaných orgánů státní správy. Pozornost je nejdříve soustředěna na charakteristiku základních pojmů, které jsou obsaženy v názvu práce. Následně je provedeno vymezení územně dekoncentrovaných orgánů státní správy, které disponují právotvornou pravomocí. V závěrečné části je věnována pozornost problematickým aspektům a specifikům právotvorné činnosti. Jedinými zástupci normativních správních aktů územně dekoncentrovaných orgánů státní správy jsou tzv. mimořádná opatření. Některé územně dekoncentrované orgány státní správy mají pravomoc vydávat mimořádná opatření rovněž ve formě opatření obecné povahy, přičemž právní forma má zásadní vliv na úroveň ochrany veřejných subjektivních práv. Z tohoto důvodu se diplomová práce taktéž zabývá otázkou, jaká je vhodná právní forma pro daná mimořádná opatření.

Abstract:

The diploma thesis deals with normative administrative acts of territorially deconcentrated state administration authorities. Attention is first focused on the characteristics of the basic concepts that are contained in the title of the thesis. After this characteristic, attention is focused on the definition of territorially deconcentrated state administration authorities, which have the legislative competence. In the final part, attention is paid to problematic aspects and specifics of the legislative process. The only representatives of normative administrative acts of territorially deconcentrated state administration authorities are the so-called extraordinary measures. Some territorially deconcentrated state administration authorities have power to issue extraordinary measures also in the form of measures of a general nature, while the legal form has a fundamental effect on the level of protection of public subjective rights. For this reason, the thesis also deals with the question of what the appropriate legal form for the extraordinary measures is.
