Use of firearm for the necessity defense as a ground of justification

Abstract:

Tato diplomová práce se zabývá problematikou použití zbraně v rámci nutné obrany. Pro pochopení institutu nutné obrany v rámci širšího kontextu jsou v úvodní kapitole stručně popsány jednotlivé okolnosti vylučující protiprávnost. Následující kapitola se zaměřuje na samotný trestněprávní institut nutné obrany, jeho stručnou historii, podmínky nutné obrany a možné vybočení z jejich mezí. Třetí kapitola pojednává o terminologii právní úpravy zbraní a členění zbraní z pohledu právní teorie. Jádrem práce je kapitola čtvrtá, která pojednává o výhodách použití zbraně v nutné obraně a některých omezeních z toho vyplývajících. Východiska použití zbraně v rámci nutné obrany jsou následně demonstrována na konkrétním případu z praxe, za použití bohaté judikatury vztahující se k této problematice. Dále je rozebráno i ústavní ukotvení práva na obranu života se zbraní. Pátá kapitola je exkurzem do problematiky instalace a použití automatických obranných zařízení. V závěru práce je zhodnocena současná právní úprava nutné obrany dle § 29 zákona č. 40/2009 Sb., trestního zákoníku a držení zbraní občany dle zákona č. 119/2002 Sb., o střelných zbraních a střelivu, načež jsou formulovány určité návrhy de lege ferenda.

Abstract:

This diploma thesis deals with the issue of the use of weapons in the framework of necessity defense. In order to understand the institute of necessity defense within the broader context, the introductory chapter briefly describes the individual circumstances excluding illegality. The following chapter refers to the criminal law institute of necessity defense itself, its brief history, the conditions of necessity defense and possible deviations from their defense limits. The third chapter discusses the terminology of the legal regulation of weapons and the division of weapons from the point of view of legal theory. The focus of the work is the fourth chapter, which discusses the advantages of using weapon in necessity defense and some of the resulting limitations. The basics of using a weapon as part of necessity defense are subsequently demonstrated on a specific case from practice, using the rich case law relating to this issue. The constitutional anchoring of the right to defend life with a weapon is also analyzed. The fifth chapter is an excursion into the installation and use of automatic defense devices. At the end of the work, the current legal regulation of necessity defense according to § 29 of Act No. 40/2009 Coll. and the possession of weapons by citizens according to Act No. 119/2002 Coll. In this context certain proposals de lege ferenda are formulated.
