Examination of a witness in preparatory criminal proceedings and in tax proceedings

Abstract:

Předložená práce se zaměřuje na problematiku výslechu svědka v přípravném trestním a daňovém řízení. Práce je rozdělena na dvě části, a to na teoretickou část a praktickou část. Teoretická část bakalářská práce obsahuje výklad pojmů důležitých pro pochopení celé problematiky výslechu svědka v přípravném trestním a daňovém řízení. Věnuje se průběhu svědeckých výpovědí, a to hlavně z pohledu vyslýchající osoby. Poukazuje na obtížnost vedení svědecké výpovědi, na důležitost a časovou náročnost při přípravě vyslýchajícího na svědeckou výpověď. V teoretické části jsou vyjmenovány i podstatné rozdíly mezi výslechem svědka v trestním a daňovém řízení. Praktická část bakalářské práce se zaměřuje na zjištění případných rizik, kterým mohou být vystaveny osoby, které výslech provádějí. Následně jsou rizika analyzována pomocí univerzální matice rizikové analýzy, tj. metody UMRA. Na závěr je uvedena komparace výslechu svědka v trestním a daňovém řízení.

Abstract:

The bachelor’s thesis focuses on the questioning of a witness in pre-trial criminal and tax proceedings. The thesis is divided into two sections: the theoretical section and the practical section. The theoretical section defines and explores terms that are essential to fully understand the questioning of a witness in pre-trial criminal and tax proceedings. The section deals with the course of testimonies, especially from the point of view of the questioning person. It also points out how difficult it is to conduct a testimony and how important and time-consuming it is for the questioning person to prepare for the testimony. The theoretical section also lists the main differences between questioning witnesses in criminal and tax proceedings. The practical section focuses on potential risks the questioning persons might be exposed to. Then the risks are analysed by the Universal Matrix of Risk Analysis (UMRA method). The final section of the thesis compares questioning of witnesses in criminal and tax proceedings.
