Abstract:

Diplomová práce je zaměřena na institut místa trvalého pobytu. Krátce vymezuje historický vývoj a popis institutu v současném právním řádu České republiky. Hlavní část je zaměřena na praktickou stránku, tj. dopad jednotlivých ustanovení na praxi, funkční a organizační hledisko na daném úseku. Práce se zaměřuje na využívání moderních technologií při vedení evidence obyvatel či soulad s ochranou osobních údajů. Obsahuje také komparaci s právní úpravou Slovenské republiky. Práce hodnotí stávající právní úpravy na úseku místa trvalého pobytu a vlivu na ostatní právní předpisy s využitím jednotlivých aspektů, které danou problematiku provází, a obsahuje návrhy změn v budoucí možné právní úpravě. V diplomové práci jsou navrženy změny, které by byly přínosem jak pro klienty veřejné správy, tak pro pracovníky věnující se dané problematice. K vypracování této práce byly využity poznatky z praxe a závěry práce jsou nástinem možných řešení jednotlivých problémů na úseku trvalého pobytu a evidence obyvatel.

Abstract:

My Diploma Thesis is focused on the institute of the place of residency. In a short way there is mentioned historical development and the description of the institute in contemporary legal order of the Czech republic. The main part is focused on the using and processing in administration, it means the consequences of the particular regulation in using it and functional and organizational view of the particular administration. The Thesis focuses on using the modern technologies for keeping the evidence of citizens and the conformity with the protection of personal data. It also includes the comparison of the legislation in Slovakia. It evaluates contemporary legislation of the administration of the place of residency and the influence on the other legislation using particular aspects that are connected to the issue and it also includes possible changes in potential future legislation. In my Thesis there are suggested changes that would be contribution to public administration clients so as to clerks involved in this issue. To elaborate this Thesis there was used practical knowledge and the conclusion is the suggestion of potential solutions of the particular problems of the section of residency and evidence of citizens.
